Is CBD Oil Legal in my State?

 

The health benefits of cannabis are a hotly discussed topic. But an even hotter topic is whether or not it should be legal.

 

2016 was a milestone year for the legal cannabis industry. A record number of states passed measures to legalize recreational and medical marijuana. Now, 25 states have laws that allow some form of marijuana and public opinion continues to shift in favor of legalization. But still, many Americans live in states where recreational and medical marijuana is not legal. Further, the regulations on legal cannabis products vary widely from state to state. And because these laws are constantly changing, it can be hard to keep up with what is legal and where.

 

Where is CBD Oil Legal?

 

CBD oil is legal in 49 states and the District of Columbia. As of November 2017, Indiana made CBD illegal to possess, make and sell.

 

What is the difference between marijuana oil and CBD oil?

 

While both have therapeutic properties, marijuana and CBD are very different under the law.

 

Marijuana oil and CBD oil both come from the cannabis plant. However, marijuana oil is an extract from the marijuana variety (high in THC) and CBD oil is an extract from the industrial hemp variety (low in THC). THC is the psychoactive compound that produces a cerebral high. Since CBD contains little to no THC, it does not produce a high, only homeopathic benefits.

Federal Marijuana Policy

 

According to Section 7606 of the Farm Bill, part of the Controlled Substances Act, industrial hemp is excluded from the definition of marijuana as a controlled substance. As long as the industrial hemp plant has a THC content of less than 0.3%, it is not considered a controlled substance and is legal in 49 states.

 

Although the laws surrounding other types of cannabis products are in flux, be assured that legal CBD oil products are available nearly everywhere in the U.S.
